What is the New York City Metro Regional Center NYCMRC?

The New York City Metropolitan regional center NYCMRC is established under the EB5 Investment Visa program. It is pending to be approved by November, 2010 and designated by the United States Citizenship and Immigration Services(USCIS), a branch of the United States Department of Homeland Security as a provider of the EB-5 Regional Center Program. What types of projects for the NYCMRC investment?

All of entities meet all of the requirements for EB 5 projects as USCIS regulated. The investors will obtain EB5 Green Card successfully by investing into NYCMRC. 

How to Get a US Green Card from NYCMRC

There are 3 major steps for the attorneys to help NYCMRC investors to obtain an EB5 green card:

File Form I-526
With the help of the investor's independent immigration attorney, a NYCMRC investor must submit a completed Form I-526 (Immigrant Petition by Alien Entrepreneur) to U.S. Citizenship and Immigration Services (“USCIS”) along with supporting documents clearly demonstrating that the NYCMRC investment plan meets all EB-5 requirements, although NYCMRC reserves the right to approve and disapprove the investor’s independent attorney based upon the attorney’s experience and knowledge.

File Form I-485 or immigration visa application
After the Form I-526 is approved, the investor, if residing within the U.S., must submit a completed Form I-485 (Application to Register Permanent Residence or Adjust Status) to USCIS to obtain conditional resident status. If residing outside the U.S., the alien investor must apply for an immigrant visa at a US Consulate abroad.

Emigration to US
After a conditional Green Card is issued; the investor living outside US with immediate family is allowed to emigrate (Spouse and children under 21 at the time of application to US.
The first requirement of any investor after they receive the conditional permanent resident visa at the United States consulate office is to enter into the US within 180 days of visa issuance. Then the investor and his/her family must establish residency in the US.
 
In order to show the evidence of intent to reside in US, the investors need to open bank accounts, obtain a driver's license or social security number, pay state and federal income taxes, rent or buy a home in US.

File Form I-829 to remove “conditions”
After 1 years and 9 months, the attorney will help the investor as a conditional resident in US submit a completed Form I-829 (Petition by Entrepreneur to Remove Conditions) to USCIS within 90 days before the second anniversary of admission (approval of I-485 or admission into US territory) with supporting materials. Then the alien investor will obtain the permanent greed card.

After 4 years and 9 months of issuance of conditional green card, investor and immediate family members may apply for US citizenship.

The NYCMRC is overseen by NYC Metro Regional Center, LLC. It is set up as a Limited Liability Company in the State of New York with attorneys, economists and professionals in real estate, government and immigration in New York City. NYC Metro Regional Center, LLC consists of several entities, such as NYC Fund L.P. LLC is the general partner of the L.P., and all foreign investors are the limited partners.

Am I qualified for NYCMRC alien investor in EB5 Green Card program?

Under the law, there are no clear requirements or statements exactly listing what kind of people may apply for EB5 visa. However, according to the investment requirements, qualified EB-5 candidates must be able to invest $500,000 in NYCMRC business or entities.

NYCMRC EB5 visa petition does not require an employment offer or a labor certificate from a U.S. employer or labor department as other EB categories do. Therefore, basically the NYCMRC prospect investors usually are those who have at least $500,000 financial resources, and don’t have to have an employment offer from US. 

NYCMRC EB-5 prospects fall into but are not limited to the following scenarios:

   •Parents with enough financial support seeking U.S. education for their children, but do not want to be actively involved in business management.

   •F-1 student without managerial experience can directly apply for EB5.

   •Individual owners of a non-U.S. business, but who cannot use an L-1.

   •CEO/Managers of a U.S. company who are not an L-1 transferee.

   •Retirees without professional degree or experience, including those who do not qualify for other EB visa.

   •Entrepreneurs, including those who don’t qualify for an E-2 visa.

   •L-1 applicants from China with cases under Consular investigation

   •Investors from non-treaty countries

Must I have previous business or investment experience to obtain a Green Card in NYCMRC program?

No.

Must I have minimum education or degree to obtain a Green Card in NYCMRC program?

No.

Must I speak English to obtain a Green Card in NYCMRC program?

No. But it is strongly recommended that an alien investor can have an assistant as a translator (a friend, attorney, family member) to read our program materials and detailed information, although we offer Chinese, Korean, Spanish languages service.

Do I need a sponsor or US citizen co-signer to obtain a Green Card in NYCMRC program?

No. You do have to be over 18 years old to do financial investment. And no any sponsor or US citizen co-signer is required.

Can all of my family members get Green Cards also when my investment visa application is approved?

You, your spouse, and any unmarried children under the age of 21 can get visa after your application receive approval. It is possible for adopted children to be included as well.
